Terms of use

CNC Remote controls a real machine tool from a distance. These terms say what you can expect from the app, from CNC Remote Pro and from our online services, and what remains your responsibility.

1. Scope

These terms apply between you and Pierre Ramoin, who publishes as an individual, in Quebec, the CNC Remote app, the CNCRemote Server software, the online services that come with them (notification relay, license service, update server) and this website. By using the app or these services, you accept them.

They supplement, without replacing:

2. Safety and the operator’s responsibility

A CNC machine can cause serious injury, burns, fire and damage. CNC Remote sends commands to your machine; it does not make the machine safe.

3. CNC Remote Pro

Driving the machine is free. Which features are free and which are Pro is shown in the app and in the FAQ.

4. Online services

The notification relay, the license service and the update server are provided to make the app and the server work. We look after them with care, but do not guarantee that they are available without interruption. They limit the number of requests to protect themselves from abuse.

You agree not to disrupt these services, not to try to get around their limits or their security, and not to use them for anything but the app and the server. We may suspend access for a device or a server that does.

5. Intellectual property

The app, the server and this website are licensed, not sold. Pierre Ramoin keeps every right in them that is not expressly granted to you. The open-source components they contain are licensed to you under their own licenses, which these terms do not restrict.

6. Warranties and liability

To the extent the law allows, the app, the server and the online services are provided “as is”, with no warranty other than those the law imposes. Nothing in these terms deprives you of the legal warranties granted to you by the Quebec Consumer Protection Act, the Civil Code of Québec or any other applicable mandatory law.

To the maximum extent the law allows, Pierre Ramoin is not liable for indirect damage, for damage to machines, tools, workpieces or materials, or for lost data or profits, arising from the use of the app, the server or the online services, or from being unable to use them. His total liability is limited to the amount you paid, if any.

These limits do not apply to bodily or moral injury, nor to injury caused by intentional or gross fault: the law does not allow excluding them. If you are a consumer, they apply only to the extent the Consumer Protection Act allows.

7. Ending

You can stop using the app and our services at any time, by deleting the app and the server. To have the information we hold deleted, see the privacy policy.

8. Changes

If these terms change, we publish the new version on this page, with the date it takes effect. A change takes nothing away from a purchase already made.

9. Governing law, courts and language

These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein. Any dispute arising from them falls under the courts of the judicial district of Montréal. If you are a consumer, the mandatory consumer protection rules of your place of residence continue to apply, and you keep the right to bring proceedings before the court of your domicile.

These terms are also published in French. The French version prevails.
